These Terms of Service (“Terms”) govern your use of the Balance3Sixty Bookkeeping LLC website and any bookkeeping services provided by Balance3Sixty Bookkeeping LLC (“Balance3Sixty,” “we,” “our,” or “us”). By using our website or engaging our services, you agree to these Terms.
1. Services
Balance3Sixty provides bookkeeping and financial record-keeping services for small businesses. Our services may include monthly bookkeeping and reconciliation, financial reporting, accounts payable support, QuickBooks setup and management, and catch-up bookkeeping. Specific services, scope, pricing, and terms for each client are defined in a separate Service Agreement or engagement letter.
2. Not Accounting, Tax, or Legal Advice
Balance3Sixty provides bookkeeping services only. We are not a licensed CPA firm and do not provide accounting opinions, tax preparation, tax advice, audit services, or legal advice. We recommend that you consult with a qualified CPA for tax matters and a licensed attorney for legal matters. Any financial reports or data we provide are based on the information and records you supply to us.
3. Client Responsibilities
To enable us to perform our services effectively, you agree to:
- Provide timely and accurate financial records, bank statements, receipts, and other requested documentation.
- Grant necessary access to your QuickBooks Online account or other financial software.
- Review financial reports we deliver and promptly notify us of any discrepancies.
- Pay invoices in accordance with the agreed-upon schedule.
- Notify us of any significant changes to your business structure, accounts, or operations that may affect our services.
4. Pricing and Payment
Service pricing is provided during your initial consultation and confirmed in your Service Agreement. Monthly service fees are billed at the beginning of each month and are due upon receipt unless otherwise agreed. Late payments may be subject to a service suspension after 15 days past due. We reserve the right to adjust pricing with 30 days’ written notice.
5. Confidentiality
We treat all client financial information as confidential. We will not disclose your financial data to any third party without your written authorization, except as required by law or as necessary to provide our services (e.g., communication with your CPA at your direction). This confidentiality obligation survives the termination of our service relationship.
6. Limitation of Liability
Balance3Sixty exercises professional care in providing bookkeeping services. However, we are not responsible for errors or losses resulting from inaccurate, incomplete, or untimely information provided by you. Our total liability for any claim arising from our services shall not exceed the total fees paid by you during the three (3) months immediately preceding the claim. We are not liable for any indirect, incidental, consequential, or punitive damages.
7. Termination
Either party may terminate the service relationship with 30 days’ written notice. Upon termination, we will provide you with all completed financial records and reports. Any outstanding fees for services rendered through the termination date remain due and payable. We will securely delete or return your financial data within 30 days of termination, except as required for our legal record-keeping obligations.
8. Intellectual Property
All content on the Balance3Sixty website — including text, graphics, logos, and design — is the property of Balance3Sixty Bookkeeping LLC and is protected by copyright law. You may not reproduce, distribute, or use our website content without written permission.
9. Website Use
You agree to use our website only for lawful purposes. You may not attempt to gain unauthorized access to our website, servers, or systems. We reserve the right to modify, suspend, or discontinue any portion of our website at any time without notice.
10. Dispute Resolution
Any disputes arising from these Terms or our services shall be governed by the laws of the State of Georgia. The parties agree to attempt good-faith negotiation before pursuing any formal legal action. Any legal proceedings shall be conducted in the courts of Gwinnett County, Georgia.
11. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after changes constitutes acceptance.
